New Peruvian Customs Law

From the 1st of January 2010, a new regulation of the Decreto Legislativo Nbr. 1053 Ley General de Aduanas (New Peruvian Customs Law), Title II Chapter I about the transmission of the manifest by the Freight Forwarder directly to Customs will apply. The regulation states that “It is the Freight Forwarders responsibility to electronically send all the relevant information about each of the shipments they handle. Airfreight shipments 4 (four) hours, before aircraft arrival and Ocean freight shipments 48 (forty eight) hours, before vessel arrival”.

It is a must to have the pre-alert sent as soon as it is available in order for destination agent to check with consignees that all the information consigned on the HBL/HAWB is correct. Only then the information can be sent and comply with Peruvian customs requirement. This action can only be taken on working days. There are high fines if the procedure is not done as the new regulation states.

Therefore, pre-alerts must be sent as follows:

  • Air Freight shipments, the day before flight departs (working day/hour).
  • Air Freight shipments on weekends, by Friday morning.
  • Ocean Freight shipments latest a week after vessel departure.
  • Ocean Freight shipments, with less than 5 days of transit time, the day before vessel arrival (working day). If final BL is not available the drafts must be provided to work with.
